§ 12-2. Policy and purpose of chapter

  • (a) In view of the existing and increasing possibility of the occurrence of disasters of unprecedented size and destructiveness resulting from enemy attack, sabotage, or other hostile action, or from fire, flood, earthquake or other natural causes, and in order to ensure that preparations of this town will be adequate to deal with such disasters, and generally to provide for the common defense and to protect the public peace, health and safety, and to preserve the lives and property of the people of this town, it is hereby found and declared to be necessary:

    (1) To create a town civil defense organization;

    (2) To provide for the rendering of mutual aid to other municipalities within the state and, if necessary, and only under a compact approved by the governor, the neighboring municipalities and counties of another state;

    (3) To cooperate with the state government with respect to carrying out civil defense functions.

    (b) It is further declared to be the purpose of this chapter and the policy of this town that all civil defense functions of this town be coordinated to the maximum extent with the state government, including its various departments and agencies of every type, to the end that the most effective preparation and use may be made of this town's manpower, resources and facilities for dealing with any disaster that may occur.

    (c) It is further declared to be the purpose of this chapter and the policy of this town to organize a civil defense organization in conformity with the West Virginia civil defense plan as directed by the W. Va. Code, § 15-5-8.
